City of Upland Emerges Victorious in 27-Year Code Enforcement Battle

Upland, CA – July 2, 2018 – The San Bernardino County Superior Court has turned over the substandard residence at 1185 O’Hara Court in Upland to a court-appointed receiver following a nearly three-decade battle to obtain the property owners’ voluntary compliance with local laws. The attorneys at Silver & Wright, a Southern California law firm specializing in aiding cities with nuisance abatement to keep people safe and neighborhoods clean, helped the City of Upland achieve this victory.

The single-family residence, located in an otherwise well-maintained neighborhood, was identified as a danger to its occupants and neighbors. City inspectors repeatedly found extreme hoarding conditions throughout the entirety of the property. Other harmful conditions included fire and safety hazards, unsafe and unsanitary living conditions, exposed and dangerous electrical wiring, and excessive accumulation of junk, trash, and other debris.

The City of Upland’s request for a court-appointed receiver was a last resort attempt to bring the property up to code. Over the years, the property owners ignored numerous warnings and citations for their violations of City and State laws. The City of Upland even lent the property owners $90,000 to rehabilitate the nuisance property, and the requisite improvements were still not made.

“It’s unfair that for decades, the City of Upland and its taxpayers had to endure this property owner’s flagrant negligence and stall tactics,” said Silver & Wright attorney Rene Farjeat, who represented the City. “This was a long-sought victory for the City and for the neighbors of this property who will no longer have to suffer from these dangerous and unsightly conditions.”
